This Returns Policy forms part of, and is to be read in conjunction with the Computer Expo Terms and Conditions of Purchase . You will have arrived at this policy by clicking a link in those very terms and conditions.
Definitions in the Computer Expo Terms and Conditions apply in this returns policy.
All items sold by Us are sold on a "No Return Basis". There are however limited exceptions to this, namely where Goods are:
1. "Dead on Arrival";
2. "Damaged in Transit"; or
3. "Incorrectly Shipped".
We also provide, where relevant, limited assistance with honouring manufacturer's warranties.
Please note that unless Goods received by You from Us qualify under one of these exceptions then We may refuse to enter into any further correspondence with you. Details of the exceptions are provided below.
You are directed at all times to first consider the relevance of all and any manufacturer's warranty in relation to Goods provided by Us to You under Our terms and conditions including this Returns Policy.
We may, at Our sole discretion, revise any part of this Returns Policy from time to time without notice.
IMPORTANT : Any damage done to Goods determined at our sole and unfettered discretion to have been caused by willful damage, misuse, unauthorised repair, neglect or otherwise by Your actions or inactions (or the actions or inactions of your agents, contractees or invitees) are automatically precluded from making any legitimate claim under this Returns Policy.
RETURNS TYPES
1. Dead on Arrival
a. In the event that you receive Goods you discover are not in working order as they are unpacked ( Dead on Arrival ) then you must first refer to the manufacturer's warranty conditions and consider that BEFORE contemplating the following procedure. Failure to adhere to the manufacturer's warranty conditions by You may result in Us refusing to refund freight charges to You in a manner described in this policy. Please refer to paragraph 8 of this policy for guidance on Our expectations of You in this context.
b. Provided You have given proper consideration of the matters referred to immediately above You must, if not able to send the Goods to the manufacturer under its warranty conditions, obtain a Return Authorisation Number no later than 3 working days from the date of Your receipt of the Goods in the manner prescribed by paragraph 5 below.
c. On being issued with a Return Authorisation Number You must return the Goods to Us using the Returns Procedures stated at paragraph 5 below, such that the Goods are returned to us within 7 days of the date of receipt by You.
d. We will make a determination, at our unfettered discretion, of whether the Goods are indeed Dead on Arrival or not.
e. In the event we determine the Goods are not Dead on Arrival then the Goods will be returned to You together with an invoice for a processing fee and further delivery charges in respect of returning the Goods to You which must be paid within 30 days of invoice.
f. In the event We agree the Goods are indeed Dead on Arrival then We will, subject to the availability of the particular Goods Dead on Arrival, replace such Goods and reimburse Your costs incurred in complying with our Returns Procedures.
2. Damaged in Transit
a. In the event You receive Goods that have been damaged in the course of being dispatched to You ( Damaged in Transit ) must:
(i). preferably refuse to take receipt of the Goods should you notice such damage and request that the deliverer of the Goods return those to Us; else
(ii). immediately obtain a Return Authorisation Number no later than 3 working days from the date of Your receipt of the Goods in the manner prescribed by paragraph 5 below.
b. In the event the circumstances occur as stated at paragraph 2 (i) and We, in Our unfettered discretion, determine that the Goods have not been Damaged in Transit then We may issue you with an Invoice for all relevant delivery charges and return the Good to You.
c. In the event the circumstances occur as stated at paragraph (ii) then on being issued with a Return Authorisation Number You must return the Goods to Us using the Returns Procedures stated at paragraph 5 below, such that the Goods are returned to us within 7 days of the date of receipt by You.
d. We will make a determination, at our unfettered discretion, of whether the Goods are indeed Damaged in Transit or not.
e. In the event we determine the Goods are not Damaged in Transit then the Goods will be returned to You together with an invoice for a processing fee and further delivery charges in respect of returning the Goods to You which must be paid within 30 days of invoice.
f. In the event We agree the Goods are indeed Damaged in Transit then We will, subject to the availability of the particular Goods Damaged in Transit , replace such Goods and reimburse Your costs incurred in complying with our Returns Procedures.
3. Incorrectly Shipped
a. If You determine that Goods delivered to you are not those Ordered by You ( Incorrectly Shipped ) then You must immediately obtain a Return Authorisation Number no later than 3 working days from the date of Your receipt of the Goods in the manner prescribed by paragraph 5 below.
b. On being issued with a Return Authorisation Number You must return the Goods to Us using the Returns Procedure stated at paragraph 5 below such that the Goods are returned to us within 7 days of the date of receipt by You.
c. We will make a determination, at our unfettered discretion, of whether the Goods are indeed Incorrectly Shipped, or not.
d. In the event we determine the Goods are not Incorrectly Shipped then the Goods will be returned to You together with an invoice for a processing fee and further delivery charges in respect of returning the Goods to You which must be paid within 30 days of invoice.
e. In the event We agree the Goods are indeed Incorrectly Shipped then We will, subject to the availability of the particular Goods, replace such Goods with Goods actually Ordered and reimburse Your costs incurred in complying with our Returns Procedures.
4. Our Discretion
a. We reserve the right to determine that, despite Your returning Goods to Us with Your view that the Goods are Damaged in Transit, whereas they are actually Dead on Arrive, or vice versa, we would abide the remedy proposed by us in either case.
5. Return Procedure

All Goods to be returned, require a return authorisation number to be allocated by Us ( Return Authorisation Number ) before they can be returned.
|
|
| b. |
To obtain a Return Authorisation Number, please contact our Customer Service staff by telephone on 08 9221 2500 or by e-mail at returns@computerexpo.com.au

| c. |
You must supply the following information, most of which will be on your packing slip or invoice before we can issue a Return Authorisation Number: |
|
|
(i) Name and contact details of original purchaser;
(ii) Our reference number;
(iii) Part number of Goods to be returned;
(iv) Date on packing slip or invoice;
(v) Reason for return;
(vi) Your name and contact details; and
(vii) Such other information as we reasonably request.

| d. |
Each Return Authorisation Number is only valid for one item and must match the Goods authorised for return.
|
|
| e. |
Return Authorisation Numbers are only valid for seven days, so we must receive returned Goods into our warehouse within this period.
|
|
| f. |
It is Your responsibility to ensure that all Goods are suitably packaged in order to prevent damage during return shipping. You must not write on or attach labels to the Goods being returned.
|
|
| g. |
A copy of the original packing slip or invoice, or other proof of purchase, must be included with returned Goods.
|
|
| h. |
The Return Authorisation Number should be clearly visible on the outside of the goods-shipping carton and addressed to the address notified to you when you are given your Return Authorisation Number.
|
|
| i. |
For all returns, subject to any rights, You might have under a manufacturer's warranty or otherwise under contract or statute, the purchaser is responsible for all costs associated with return of the goods to the Vendor and the Vendor will not pay or reimburse those or any associated costs.
|
|
| j. |
All goods returned to the Vendor are to be returned via the "Approved Return Delivery Method" stated at clause 6 below.
|
|
| k. |
The Vendor accepts no responsibility for loss or damage occurring in transit on return to the Vendor.
|
|
| l. |
If an item is not returnable under this Returns Policy, and is not returned to us in the original unopened packaging, it will be returned to You at Your cost.
|
|
m. |
The Vendor will test all goods returned as "Dead on Arrival" or "Damaged in Transit" within seven days of receipt into the Vendor's warehouse. Some goods may need to be returned to the manufacturer for testing. If your goods are in full working condition or any defects or damage can be shown to have been caused after you took receipt of the goods, it will be returned to you and you will be invoiced for the processing and freight costs associated with the return. These invoiced amounts will be payable by you within 30 days of receipt of the invoice.

| n. |
Unless stated otherwise under this Returns Policy, any manufacturer's warranty or other contract or statute, The Vendor reserves the right to refuse any returns that:
|
|
|
(i) Are incomplete or missing parts;
(ii) Are not returned in their original packaging;
(iii) Show signs of physical damage to the goods or its packaging;
(iv) Do not include a valid Return Authorisation Number on the shipping label; or
(v) Have an expired Return Authorisation Number.

|
Please note that events such as willful damage, misuse, unauthorised repair or tampering with an item may prevent goods being accepted for return.
|
|
6. Approved Return Delivery Method
|
|
| a. |
All Goods for return to Us under this Returns Policy must be returned to Us by the following approved carrier or such other carrier as is notified to You by Us. If Goods are returned to the Vendor by another means/carrier, the Vendor reserves the right to refuse the delivery and all cost will be paid by the Purchaser.

7. Approved Delivery Address
|
|
| a. |
All Goods for return to Us under this Returns Policy must be returned to the approved delivery address as given by Computer Expo at notification of your Return Authorisation Number.
|
|
8. Manufacturer's Return Policy
|
|
| a. |
With the exception of goods that are clearly marked as "Ex-Demo", "Ex-Rental", "Soiled", "Second hand", "Imperfect" or "Damaged", Goods unless noted otherwise, are ordinarily sold with a full manufacturer's warranty. The warranty periods and service levels vary by manufacturer. The following paragraphs must be read subject to any conditions, exclusions or qualifications contained in this Returns Policy, a manufacturer's warranty or any other contract or statute.

| b. |
If a manufacturer offers to accept Goods for return, then we will endeavour to honour the manufacturer's returns policy where it involves Us.
|
|
| c. |
The manufacturer's returns policy may direct you to either: -
|
|
|
(i) Return the Goods directly to the manufacturer, its agent or a third party service provider (in which case you must organise that with them, not Us); or
(ii) Return the goods to the Vendor from whom the goods were originally purchased.
|
|
| d. |
If the manufacturer directs you to return the goods to Us as the Vendor, then you should contact our Customer Service (see paragraph 5b. above) to be issued with a Return Authorisation Number in accordance with the Returns Procedure specifying that the Goods are being returned under a manufacturer's returns policy. You must also provide any additional information that may be required under the manufacturer's returns policy, or by Us.

| e. |
Where possible (and to the extent consistent with the manufacturer's returns policy), you will need to package and address the goods for return in accordance with the above procedures (see paragraph 5 above) and you will need to arrange for return delivery (as per paragraph 6 above) of the goods to Us at the address ("Approved Delivery Address") listed in the above procedures.

| f. |
The Vendor will not pay or reimburse any costs associated with a Purchaser organised shipment unless it agrees to do so or is required to do so under this Returns Policy. Our warehouse must receive the Goods within the period specified by the Manufacturer otherwise the return may not be authorised in some circumstances. For goods, which are validly returned under a manufacturer's return policy, a replacement Item will be issued. Note: If the exact Item/s have been discontinued or are permanently unavailable a similar Item with similar specifications may be issued.

| g. |
If Goods have not been validly returned under a manufacturer's return policy, they will be returned to You and You will be invoiced a processing fee and freight costs associated with the return. These invoiced amounts are payable by you within 30 days of receipt of invoice.

9 |
Software Goods
|
| a. |
Defective or damaged software can be returned as per "Dead on Arrival" or "Damaged in Transit" procedures.
|

|
|
|
|
10 |
Processing Credits/Refunds
|
| a. |
We will only issue refunds upon exceptional and extraordinary circumstances. In all circumstances, we will elect that a replacement Good or repair is sufficient remedy instead of a credit. This election may be at Our sole discretion, but will be in accordance with relevant warranties, other contracts and statutes. If we elect to have a Good replaced or repaired, we will do this at our cost and return the Goods to you accordingly. Note that if You have paid Us by credit card then we, as a matter of policy and common practice, will refund to your credit card. |
